Terms of Service

These terms are an agreement between you and Ahmad Abdel-Yaman, trading as Mind Games Boutique ("we", "us") about your use of Qwestions, the trivia game, on iOS and Android. By creating an account or playing, you agree to them. If you do not agree, please do not use the app.

1. Who can play

• You must be at least 13 years old. The app asks for your birth year and will not create an account for anyone younger.
• If you are under 18, you need a parent's or guardian's permission to use the app and to make any purchase.
• Creating and running a family group requires being 18 or older.

2. Your account

• You can sign in with Apple on iPhone, with Google on Android, or play as a guest.
• A guest account lives on your device. If you delete the app or lose the device, the account, its progress and any Sparks in it cannot be recovered. Sign in with Apple or Google to keep your progress.
• You are responsible for activity on your account. Tell us at [email protected] if you think someone else is using it.

3. The questions

Questions are written with the help of AI and checked by a second automated review before they reach the game, with a sample also reviewed by a person. Even so, a question can be wrong, outdated or unclear. Please tell us at [email protected] when you find one. The game is entertainment, not a reference: do not rely on it for facts that matter.

4. Sparks, lives and purchases

• Sparks, the game's currency, and lives are virtual items used only inside the game. They have no cash value, cannot be exchanged for money, and cannot be sold or transferred to another account.
• Sparks are bought through the App Store or Google Play and are subject to their terms. The store charges you, and refund requests go to the store, not to us.
• If a store refunds a purchase, we remove the Sparks that purchase added. If you have already spent them, your balance goes to zero; it never becomes negative.
• We may change prices, the Sparks a purchase includes, and how Sparks and lives work in the game. A change does not take away Sparks you already have.
• Deleting your account, or its termination under section 6, ends your Sparks and lives with it.

5. Playing fairly and respectfully

You agree not to:

• choose a display name or username that is offensive, hateful, sexual, or that impersonates someone else;
• harass, threaten or abuse other players;
• cheat: automate play, exploit bugs, or tamper with the app, its purchases or our servers;
• copy, resell or republish the questions or other content of the app;
• use the app in a way that breaks the law.

We may rename a display name or username that breaks these rules.

6. Ending your use

You can stop playing and delete your account at any time, from Profile in the app, or as described on Delete your account. We may suspend or close an account that seriously or repeatedly breaks these terms, and we will tell you why unless the law prevents it.

7. Our content

The app, its questions, artwork and software belong to us or our licensors. We give you a personal, non-transferable licence to use the app for your own entertainment. These terms do not give you any other rights to it.

8. The service as it is

We work to keep Qwestions running and accurate, but we provide it as it is and as available. We do not promise it will always be uninterrupted or error-free, and we may change or stop features. Nothing in these terms limits rights you have as a consumer that the law says cannot be limited.

To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to exclude or limit.

9. Changes to these terms

We may update these terms. The date at the top shows the latest version, and a significant change is announced before it takes effect. Continuing to play after that means you accept the new terms.

10. Law and disputes

These terms are governed by the laws of England and Wales, and disputes go to the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. If you live in the European Union or another place whose consumer law gives you the right to bring a claim where you live, you keep that right.
